About
Attorney Kennedy’s background in intellectual property and business law covers a broad and varied landscape.
Attorney Kennedy has been involved in five federal patent infringement trials as a fact witness. These include Costco Wholesale Corporation v. Acushnet Holdings Corp. (2:17-cv-00423), CALLAWAY GOLF V ACUSHNET COMPANY, No. 09-1076 (Fed. Cir. 2009), and Spalding & Evenflo Cos. 1 v. Wilson Sporting Goods Co., No. 97-30275-MAP(D. Mass.June 9, 1999).
The patent prosecution of highly technical subject matter before both the USPTO and WIPO is a specialized skill of attorney Kennedy. Subject matter that attorney Kennedy has prosecuted includes Bayesian hierarchical test methods, carbon nanotube manufacture, and golf equipment materials, designs, and configurations.
As a named inventor on over 250 US patents, attorney Kennedy has a very specialized view of the prosecution process through the USPTO and WIPO that inventors face when attempting to codify their inventions with an issued patent. His background in biology, biochemistry, microbiology, analytical chemistry, polymer chemistry, materials science, machine learning, and industrial processes allow him to gain a unique perspective of the invention and innovation that is part and parcel with the patent and trade secret processes.
Through his work as the Chief Innovation Officer at five separate startups, attorney Kennedy has deep experience with consulting contracts, nondisclosure agreements, licensing agreements, and merger and acquisition processes.
